Research: Public Participation in the Conclusion and Implementation of Production Sharing Agreements (PSAs)

The goal of the project is to strengthen the capacity of communities to influence the content and implementation of Production Sharing Agreements (PSAs) through in-depth research of regulatory frameworks, practices of interaction between communities, the state, and companies, as well as analysis of existing cooperation cases to develop practical recommendations and engagement models.

The project will contribute to the advocacy and protection of the interests of residents of territorial communities located in areas where the extraction of nationally significant mineral resources takes place. The research findings will be used to facilitate public dialogue on resource justice.

The Agreement between Ukraine and the United States on a Strategic Partnership in the Field of Critical Minerals, signed on May 1, 2025, provides for the establishment of the U.S.-Ukraine Reconstruction Investment Fund, to be financed in part from revenues generated by subsoil use. Production Sharing Agreements (PSAs) are becoming the main mechanism for attracting investors, with tenders already announced for the Mezhyhirya and Svichanska sites. This opens up potential for communities to receive social support, yet most still lack real tools to influence the terms of such agreements.

Without institutionalized community participation in the process of negotiating and monitoring PSAs, communities risk being excluded from decision-making processes that directly affect their development and recovery. The research will help identify legislative gaps, missing channels of influence, and inform the development of advocacy recommendations. The project aims not only to provide communities with knowledge but also to lay the groundwork for policy changes that will ensure their real involvement in strategically important resource governance processes.

As part of the project, the following activities are planned:

  • Analysis of the legal and procedural frameworks for the participation of local self-government bodies (LSGs) and the public in the negotiation and implementation of PSAs — including identification of gaps, inconsistencies, and restrictions in current legislation.

  • Study of actual communication practices between communities, companies, and authorities during the coordination of social obligations under PSAs — including how communities learn about such agreements and how they can influence them.

  • Collection and comparison of cases of effective and ineffective interaction between communities and companies within PSAs, highlighting the factors that contributed to or hindered the achievement of community-beneficial outcomes.

  • Development of a practical guide for territorial communities, including:

    • an overview of participation opportunities;

    • typical company obligations;

    • examples of monitoring mechanisms;

    • local-level advocacy tools.

  • Preparation of policy and legislative recommendations to support transparent participation of LSGs and the public in the management of natural resources through PSAs.

The project is implemented with the support of the Askold and Dir Fund, administered by ISAR Ednannia within the project “Strong Civil Society for a Resilient Ukraine – a Driver of Reforms and Democracy,” funded by the governments of Norway and Sweden.
